By paying an invoice, requesting service, or maintaining an active service schedule with Brooks Haven Pool & Spa (the "Contractor"), the Customer (the "Owner") agrees to the following terms and conditions. These terms constitute a binding agreement for all maintenance, repair, and service work performed.
- Scope of Services: The Contractor shall provide labor, equipment, and chemicals to perform pool maintenance as outlined in the specific service plan (Weekly, Bi-Weekly, or Service Call) selected by the Owner. Included Tasks: Skimming surface debris, vacuuming, brushing walls/tiles, testing water chemistry, and cleaning all baskets and filters. Chemicals: Standard maintenance chemicals (Chlorine, Acid, Shock) are included in the standard service fee. Specialty chemicals or treatments are billed separately. Exclusions: This agreement does not include structural repairs, leak detection, or equipment replacement. Such services will be communicated and billed as separate line items.
- Payment Terms: Acceptance: Payment of any invoice confirms the Owner’s acceptance of these terms. Due Dates: Payments are due according to the schedule provided on the individual invoice. Late Fees: Late payments are subject to interest at a rate of 24% per annum or the maximum permitted by South Carolina law. Suspension: Contractor reserves the right to suspend all services immediately if an account becomes past due.
- Owner Responsibilities: Water & Access: Water Level: The Owner is responsible for maintaining the pool water at the proper level (typically mid-tile). Low water levels can cause catastrophic pump failure or melted plumbing. Notification: The Owner must notify the Contractor immediately if a significant drop in water level is noticed. Liability: Contractor is not responsible for pump burnout, plumbing damage, or structural issues resulting from low water levels or the Owner’s failure to provide timely notification of water loss. Site Access: The Owner must ensure the pool area is accessible (gates unlocked) and all pets are secured prior to the technician’s arrival.
- Maintenance Plans & Recovery Fees: Year-Round Service: Maintaining service year-round is the most effective way to prevent algae. Owners on a year-round plan do not require formal "Winterization" or "Opening" procedures, and those specific labor fees are waived. Green-to-Clean: If the Owner opts out of year-round service and the pool turns green, a "Green to Clean" recovery service will be required and billed as a separate, labor-intensive event.
- Equipment & Liability: Warranty: New equipment installations are subject to the manufacturer’s warranty. Acts of God: Contractor is not responsible for equipment failure due to lightning, freezes, floods, or other "Acts of God." Chemistry: Environmental factors (heavy rain, high bather loads) may cause fluctuations. Contractor is not liable for chemistry changes that occur between scheduled visits.
- Waiver of Liability & Hold Harmless: The Owner voluntarily assumes all risks associated with pool ownership, including but not limited to drowning or chemical exposure. The Owner agrees to indemnify and hold Brooks Haven Pool & Spa harmless from any claims, damages, or losses arising out of the use of the pool by the Owner, their guests, or family members.
- Termination: Either party may terminate the service relationship with thirty (30) days' written notice. The Owner remains liable for all services and chemicals provided up to the date of termination.
